✓ Relazioni omosessuali legali ✗ Matrimonio egualitario ✓ Eventi Pride ⚖️ Same-sex relations have been legal in El Salvador since 1822 and the age of consent is equal, but the constitution and the Family Code limit marriage to a man and a woman, same-sex couples cannot adopt, and challenges to the marriage ban were thrown out by the Constitutional Chamber in 2016 and 2019. Sexual orientation and gender identity were added to the hate crime law in 2015 with penalties of three to six years, and a 2010 decree bans discrimination in the public sector only; private employment, housing and services are unprotected. A 2022 ruling ordered a name-change route for trans people that the Assembly never implemented, gender-affirming surgery is prohibited, and legal gender change is not possible. Under Nayib Bukele the direction is backwards: in February 2024 the Education Ministry removed 'all traces' of gender perspective from school curricula, the Ministry for Social Inclusion was dissolved, and inclusive language was banned in public institutions in 2025. Bukele has said he will never legalise same-sex marriage. Violence against trans women is the gravest issue; around 500 hate crimes were recorded between 1998 and 2015, and police cooperation is poor.
