Gay Honduras

No — same-sex marriage is not currently recognised in Honduras. Same-sex relations have been legal in Honduras since 1899 with an equal age of consent, but a 2005 constitutional amendment bans same-sex marriage and de facto unions, refuses recognition of foreign marriages and bars adoption by same-sex couples, and requires a supermajority to reverse. Hate motivated by sexual orientation or gender identity has been an aggravating factor since 2013 and the penal code penalises denial of services and incitement on those grounds, provisions kept in the 2017 code. Legal gender change is not possible. In 2021 the Inter-American Court of Human Rights found the state responsible for the 2009 killing of trans activist Vicky Hernández and ordered a gender identity procedure, which Congress has still not enacted. The violence is the defining fact: Red Lésbica Cattrachas has counted more than 400 LGBTQ murders since 2009, including activists Walter Tróchez, Erick Martínez and Thalía Rodríguez, with almost no convictions, and police use the Law on Police and Social Affairs to detain trans women. Around 17 percent of Hondurans support same-sex marriage. San Pedro Sula and Tegucigalpa have small, careful scenes; Roatán and Utila are relaxed with foreign visitors.
