⚖️ Jamaica still criminalises sex between men under the 1864 Offences Against the Person Act: buggery carries up to ten years with hard labour and 'gross indecency' up to two. Sex between women is not covered. A 2011 constitutional amendment explicitly bans same-sex marriage and any other recognised union and shields the old sexual offences from constitutional challenge; in October 2023 the Supreme Court dismissed Maurice Tomlinson's challenge on exactly that ground, and his appeal is heading to the Privy Council. There is no anti-discrimination law covering sexual orientation beyond civil service rules, no adoption for same-sex couples and no legal gender change. The violence is documented: activist Brian Williamson was killed in 2004, teenager Dwayne Jones in 2013, activist Dexter Pottinger in 2017, and a 2013 survey found a majority of LGBTQ Jamaicans had faced homophobic violence in public. Montego Bay Pride was cancelled in 2019 after officials blocked the venue. At least 60 percent of Jamaicans oppose acceptance of homosexuality. Kingston has a resilient underground community and J-FLAG is active. For tourists the all-inclusive resorts are safe and used to gay guests; outside them, discretion is essential.
