Bandar Seri Begawan BND 14:16 GMT+08:00 High Risk for LGBTQ+
✗ Same-sex relations legal ✗ Same-Sex Marriage ✗ Pride Events ⚖️ Brunei criminalises same-sex relations twice over. The secular Penal Code, inherited from British rule in 1906, carries up to ten years in prison. The Syariah Penal Code, applied in full from April 2019, provides death by stoning for anal sex between Muslim men if proven by confession or four male witnesses, with imprisonment and caning as the lesser penalties, and up to ten years and forty lashes for sex between women. Under international pressure the Sultan extended the country's death-penalty moratorium to the Sharia code in May 2019; as an absolute monarch he can lift it at any time, and the flogging and prison provisions remain live. There is no recognition of same-sex couples, no anti-discrimination protection, no legal gender change, and cross-dressing has been prosecuted. Enforcement against private conduct is rare, but police monitor LGBTQ activity, permits for events are refused, and the community is almost entirely hidden; a 2011 university study could find fewer than thirty people willing to identify. Visitors transiting Bandar Seri Begawan are not targeted but should be fully discreet and avoid apps.
