⚖️ Myanmar retains Section 377 of the colonial Penal Code, which punishes 'carnal intercourse against the order of nature' with up to ten years in prison, and police use Section 35 of the Police Act, the 'darkness law', to detain anyone suspicious after dark, which in practice means trans women. Enforcement of 377 against consenting adults was inconsistent even before 2021; the activist Aung Myo Htut was arrested under it in 2018. The February 2021 coup ended the brief opening in which Yangon Pride drew 10,000 people in 2018 and 74 percent of Burmese told pollsters homosexuality should be legal. LGBTQ activists were prominent in the 2021 protests and many have joined the resistance or fled; the junta's crackdown on civil society has closed most of the organisations that emerged during the democratic decade. There is no recognition of same-sex couples, no anti-discrimination protection, no legal gender change. Yangon's bars and the nat kadaw spirit-medium tradition gave the community some visibility, but the country is now at war and most governments advise against travel. Those who go should assume no legal protection.
