When the German Basic Law came into force in 1949, it was shaped by the lessons learned from the inhumane policies of National Socialism. Right at the forefront, in Article 3, Paragraph 3, is the prohibition of discrimination:
“No one shall be discriminated against or favored because of their sex, their ancestry, their race, their language, their origin and homeland, their faith, or their religious or political opinions. No one shall be discriminated against because of their disability.”
However, despite their systematic persecution under the Nazi dictatorship, queer people were not mentioned. As a result, it was possible for gay and bisexual men to be criminally prosecuted for decades under the shameful paragraph §175. More than 100 organizations and prominent initial signatories are demanding with the campaign “Basic Law for All” that protection against discrimination based on sexual and gender identity be included in Article 3 of the Basic Law.
