⚖️ Sections 162, 163 and 165 of the Kenya Penal Code criminalise same-sex relations between men with up to 14 years in prison. The High Court upheld these sections in May 2019; the appeal is before the Court of Appeal, which listed it for hearing in 2026. In February 2023 the Supreme Court separately affirmed that LGBTQ+ organisations have a constitutional right to register (the NGLHRC case) - a civil-rights ruling that did not change the criminal law. No recognition of same-sex couples.
