Same-sex partnerships are recognised in Poland, though full marriage may still be pending. The Legal Status panel above has the current position. Poland decriminalised same-sex relations in 1932, earlier than most of Europe, and has had employment anti-discrimination protection for sexual orientation since 2003. Everything else stalled for decades: Article 18 of the constitution protects marriage as a union of a man and a woman, same-sex couples cannot adopt (a 2021 law also vets single adopters for same-sex cohabitation), and 'LGBT-free zone' resolutions covered a third of the country in 2019 until EU funding pressure and court rulings erased the last of them in February 2024. The Tusk government has tried to legislate recognition: a registered partnership bill passed the Sejm in February 2026 and a narrower 'closest person' act in May 2026, but President Nawrocki has said he will not sign partnerships, and President Duda vetoed a hate speech bill covering sexual orientation in April 2025. The courts cut both ways in 2026, with the Supreme Administrative Court ordering registry offices to transcribe EU same-sex marriages in March and the Constitutional Tribunal ruling that unconstitutional in July. Legal gender change still goes through the courts, simplified in 2025. Public support for recognising same-sex relationships has risen to two-thirds. Warsaw and Kraków have confident scenes and Warsaw's Equality Parade draws tens of thousands.
